By accessing or using Wheelly ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.
We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms in the app or sending an email notification. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
2. Eligibility
2.1 Age Requirements
You must be at least 16 years old to use Wheelly
If you are under 16, you may not use the Service
We reserve the right to verify your age and terminate accounts of underage users
2.2 Account Requirements
You must provide accurate and complete information when creating an account
You are responsible for maintaining the security of your account credentials
You are responsible for all activities that occur under your account
You must notify us immediately of any unauthorized access to your account
2.3 Prohibited Users
You may not use the Service if:
You are under 16 years old
You have been previously banned from the Service
You are located in a jurisdiction where the Service is prohibited
Your use of the Service would violate applicable laws or regulations
3. User Accounts & Registration

You must create an account to use most features of the Service

You must keep your account information updated
You may not create multiple accounts

You are responsible for all activities that occur under your account

You may delete your account at any time through app settings

Illegal Activities: Engage in any illegal activities, including but not limited to:
Illegal street racing
Reckless driving
DUI/DWI while using the app
Drug trafficking
Weapons trafficking
Human trafficking
Any activity that violates applicable laws or regulations
Harassment & Abuse: Harass, abuse, threaten, or harm other users, including:
Stalking or following users without consent
Sending unwanted messages or communications
Posting threatening or abusive content
Doxxing or sharing private information
Bullying or intimidation
Content Violations: Post, share, or transmit content that:
Is illegal, harmful, or violates applicable laws
Infringes on intellectual property rights
Contains hate speech or discriminatory content
Contains pornography or sexually explicit content
Contains violence or graphic content
Promotes illegal activities or dangerous behavior
Safety Violations: Engage in activities that endanger safety, including:
Organizing illegal street racing events
Promoting dangerous driving behaviors
Organizing illegal gatherings or riots
Encouraging unsafe riding or driving practices
Spam & Misuse: Engage in spam, fraud, or misuse of the Service:
Spamming or sending unsolicited messages
Impersonating other users or entities
Creating fake accounts or profiles
Scraping or harvesting user data
Reverse engineering or decompiling the app
Interfering with the Service's operation
4.2 Event & Meetup Rules
Events must comply with applicable laws and regulations
Events may not promote illegal activities
Events may not endanger public safety
Event organizers are responsible for event safety
We reserve the right to remove events that violate these Terms
4.3 Vendor Rules
Vendors must comply with applicable laws and regulations
Vendors may not sell illegal products or services
Vendors are responsible for product safety and quality
Vendors must provide accurate product descriptions
We reserve the right to remove vendors that violate these Terms
5. Content & User-Generated Content
5.1 User Content Ownership
You retain ownership of content you post, share, or transmit
You grant us a license to use, display, and distribute your content
You grant us the right to modify, adapt, and translate your content
You grant us the right to use your content for marketing and promotional purposes
5.2 Content License
By posting content on Wheelly, you grant us:
A worldwide, non-exclusive, royalty-free license to use your content
The right to display, distribute, and promote your content
The right to modify, adapt, and translate your content
The right to use your content for marketing and promotional purposes
5.3 Content Responsibility
You are solely responsible for content you post, share, or transmit
You represent that you have the right to post content
You represent that content does not violate any third-party rights
You agree to indemnify us for any claims arising from your content
5.4 Content Removal
We reserve the right to remove any content that violates these Terms
We reserve the right to remove content that violates applicable laws
We reserve the right to remove content that endangers safety
We may remove content without prior notice
6. Location Services & Ride Tracking
6.1 Real-Time Location Sharing
Wheelly collects and processes real-time location data during active rides
Location data is shared with other users in your active ride group
Location data may be shared with event organizers for event attendance
You can disable location services at any time through device settings
6.2 Location Data Accuracy
Location data accuracy depends on GPS signal strength and device capabilities
We do not guarantee the accuracy of location data
Location data may be inaccurate due to environmental factors
We are not liable for any consequences of inaccurate location data
6.3 Location Data Privacy
Location data is processed in accordance with our Privacy Policy
Location data is encrypted in transit and at rest
Location data is shared only with authorized users
You can delete location data at any time through app settings

Wheelly does not provide emergency services or navigation services
Wheelly does not guarantee the accuracy of location data
Wheelly does not guarantee the safety of events or meetups
Wheelly does not guarantee the safety of routes or destinations
7.2 Liability Limitation
WHEELLY IS NOT LIABLE FOR:
Accidents or Injuries: Any accidents, injuries, or deaths that occur while using the Service
Route Safety: Any consequences of following routes or directions provided by the Service
Event Safety: Any consequences of attending events or meetups organized through the Service
User Interactions: Any consequences of interactions with other users
Location Data Accuracy: Any consequences of inaccurate or missing location data
Service Availability: Any consequences of service outages or interruptions
7.3 Assumption of Risk
YOU ASSUME ALL RISKS ASSOCIATED WITH:
Using the Service while riding or driving
Following routes or directions provided by the Service
Attending events or meetups organized through the Service
Interacting with other users through the Service
Sharing location data with other users

The Service is provided "as is" without warranty of any kind
We do not warrant that the Service will be uninterrupted or error-free
We do not warrant that the Service will meet your requirements
We do not warrant the accuracy, completeness, or usefulness of any information
8. Prohibited Uses
8.1 Illegal Activities
You may not use the Service to:
Engage in illegal street racing
Organize illegal gatherings or riots
Promote illegal activities or dangerous behavior
Violate any applicable laws or regulations

You may not use the Service to:
Encourage reckless driving or dangerous riding
Promote unsafe driving or riding practices
Organize events that endanger public safety
Share content that promotes dangerous behavior
8.3 Harassment & Abuse
You may not use the Service to:
Harass, abuse, or threaten other users
Stalk or follow users without consent
Send unwanted messages or communications
Post threatening or abusive content
8.4 Intellectual Property
You may not use the Service to:
Infringe on intellectual property rights
Post content that violates copyright or trademark rights
Reverse engineer or decompile the app
Scrape or harvest user data

You may delete your account at any time through app settings
Account deletion removes all personal data within 30 days
Some data may be retained for legal compliance (transaction records)

We may terminate accounts that violate these Terms
We may terminate accounts for illegal activity or safety concerns
We may terminate accounts without prior notice

Upon termination, your right to use the Service immediately ceases

BY USING WHEELLY, YOU ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTOOD THESE TERMS OF SERVICE AND AGREE TO BE BOUND BY THEM. IF YOU DO NOT AGREE TO THESE TERMS, YOU MAY NOT USE THE SERVICE.
